Terms of Service

These terms govern your use of ofemil.com and any order you place through it. By using the site or placing an order, you accept them. Please read them alongside our Privacy Policy, Shipping and Returns & Refunds pages, which form part of these terms.
1. Who we are
OF EMIL is a trading name of Aaron Paul Luke, a sole trader based at Studio 8A, Leyton Green Studios, 778 High Road, London, E10 6AE.

2. Placing an order
Our product listings are an invitation to treat, not an offer. Your order is an offer to buy.
A contract is formed only when we send you a dispatch confirmation email. The order confirmation you receive immediately after checkout acknowledges that we've received your order; it doesn't accept it.
We may decline an order where the item is out of stock, where we've identified a pricing or description error, where we're unable to authorise your payment, or where we suspect fraud. If we decline after taking payment, we'll refund you in full.
3. Prices and payment
Prices are shown in the currency selected at checkout and, for UK orders, include VAT. Delivery is charged separately and shown before you pay.
We take payment at the point of order. Prices may change at any time, but changes won't affect an order we've already confirmed.
If we discover an obvious pricing error before dispatch — a piece listed at a fraction of its true price, for instance — we'll contact you to ask whether you want to proceed at the correct price or cancel. We're not obliged to fulfil an order at a manifestly incorrect price.
Prices displayed in currencies other than GBP are converted at prevailing rates and may vary. Your card issuer may apply its own rate and charges.
4. Products
Our pieces are made in small runs from natural fibres. Slubs, minor irregularities in weave, and small variations in colour and measurement between pieces are characteristics of silk and linen, not defects.
We photograph everything as accurately as we can, but screens differ, and colour on your device may not match the finished garment exactly.
Availability is not guaranteed until dispatch.
5. Your rights as a consumer
Nothing in these terms limits your statutory rights. Under the Consumer Rights Act 2015 goods must be of satisfactory quality, fit for purpose and as described. Under the Consumer Contracts Regulations 2013 you have a 14-day right to cancel most online orders. Both are set out in full on our Returns & Refunds page.
6. Using this site
You may use this site for your own personal, non-commercial purposes. You may not use it unlawfully, attempt to gain unauthorised access to it, introduce malicious code, scrape it systematically, or use it in any way that damages it or interferes with anyone else's use of it.
We may suspend, withdraw or restrict the site at any time, and we don't guarantee it will always be available or uninterrupted.
7. Intellectual property
All content on this site — including the OF EMIL name and logo, photography, garment names, product descriptions and design — belongs to us or is licensed to us, and is protected by copyright and trade mark law.
You may view and print pages for personal use. You may not reproduce, distribute, or use any of it commercially, or use our photography or copy to sell goods, without our written permission.
8. Accounts
If you create an account, keep your password confidential and tell us promptly at aaron@modernstarsilk.co.uk if you think someone else has access to it. You're responsible for activity on your account. We may suspend or close an account that has been used in breach of these terms.
9. Our liability
We're responsible for loss you suffer that is a foreseeable result of our breaking these terms or failing to use reasonable care and skill. We're not responsible for loss that isn't foreseeable.
We don't limit our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else the law doesn't permit us to limit.
We don't supply products for business use, and we won't be liable for loss of profit, loss of business, business interruption, or loss of business opportunity.
Where we're liable, our liability for any order is limited to the amount you paid for it.
10. Events outside our control
We're not liable for delay or failure to perform caused by events beyond our reasonable control, including strikes, postal disruption, extreme weather, fire, flood, epidemic, or failure of public networks. If such an event occurs we'll contact you and either extend delivery times or, if the delay is substantial, allow you to cancel for a full refund.
11. Third-party links
This site may link to sites we don't control. We're not responsible for their content and don't endorse them.
12. Changes to these terms
We may amend these terms at any time. The version in force when you place an order is the one that applies to it. The date at the top shows when we last made changes.
13. Complaints
If something has gone wrong, email aaron@modernstarsilk.co.uk and we'll do our best to put it right. We aim to acknowledge complaints within [2] working days and resolve them within [14].
If we can't resolve it between us, you can seek free advice from Citizens Advice at citizensadvice.org.uk or on 0808 223 1133.
14. General
If any part of these terms is found to be unenforceable, the rest remains in force. If we don't insist on something immediately, that doesn't prevent us from doing so later. This contract is between you and us; nobody else has the right to enforce it.
You may not transfer your rights under these terms without our agreement.
15. Governing law
These terms are governed by the law of England and Wales, and disputes will be subject to the non-exclusive jurisdiction of the courts of England and Wales. If you live in Scotland or Northern Ireland, you may also bring proceedings in your own courts.
